Disney’s new initiative will allow customers to access movies, tv shows and Disney media from anywhere

Walt Disney Co. has been hard at work on a new project, dubbed “Keychest”.  The technology could contribute to a shift in what it means to own a movie or tv show. Today, most people watch movies they’ve purchased on their DVD player, computer, or other device. The limitation we face today, of having to watch media from a file or dvd that we own, could be eliminated by this new endeavor.

Keychest would allow customers to play a flat rate for permanent access to a movie or TV show. SO, whether you’re at home, at a friend’s house or out of the country traveling for business, you can still access your favorite Disney movie or TV show.

Using the same cloud computing model as other web-based applications, like Google Docs, Soundcloud, and FrameChannel, Keychest could permit users to store files on servers in lieu of taking up valuable hard drive space on their own computers.

Mediafly channel coming to Roku Digital Media Player

Roku Netflix PlayerCNET recently announced that podcast aggregator, Mediafly will soon be available on the Roku media player. Mediafly will make content available from popular television and web content providers, including Comedy Central, CNN, ESPN, and NBC. While these programs are easily available on a PC, the Mediafly channel should provide a quick and easy way to enjoy them on a TV or living room audio system as well. The capability to access audio and video podcasts exists on competing products such as Apple TV and TiVo DVRs, but both of them are considerably more expensive than the $99 Roku box.

An article in yesterday’s New York Times featured FrameChannel in a review of the new Toshiba wifi frames. While the author didn’t give a glowing review to the frames he mentioned (Toshiba and HP), he was pleased with FrameChannel and it’s vast content offerings.

Vudu streaming video service to be embedded in select LG TVs

vudu_logo_2_270x152A CNet article today announced that Vudu’s Internet video-on-demand service will be coming to select LG TVs in August. The service will effectively embed the functionality of the Vudu BX100 set-top box into the televisions.

The Vudu feature will appear on LG’s LH50 LCDs and the PS80 plasmas along with other interactive features already on those sets, including Netflix, YouTube, and Yahoo Widgets.

Frame Media, Inc. Announces Favorable Decisions by the PTO and the District Court

WELLESLEY, MA–(Marketwire – June 10, 2009) – Frame Media, Inc. (www.framemedia.com) the leader in delivering content to the “fourth screen,” has received favorable decisions from the U.S. Patent Office and Trademark Office (“PTO”) and the U.S. District Court related to a patent infringement lawsuit filed in the Central District of California by Ceiva Logic, a digital photo frame maker. The suit alleges that Frame Media’s FrameChannel service infringes on one of Ceiva’s patents. The PTO has initially rejected most of the claims of that patent, and the District Court has denied Ceiva Logic’s motion to preliminarily enjoin the FrameChannel service and has stayed the lawsuit pending the PTO’s reexamination of the patent.

The PTO has agreed to an inter partes reexamination of all claims — except for one dependent claim — of the Ceiva Logic patent. At the same time, the PTO issued an initial office action rejecting all independent claims and most of the dependent claims as being obvious in view of various prior art documents.

Frame Media Founder and CEO Alan Phillips said, “Our position from the beginning hasn’t changed. We believe that Ceiva Logic’s patent is invalid. The decision by the U.S. Patent and Trademark Office to reexamine and reject the claims of this Ceiva patent are the early steps in the process. Although the process may be a long one, we are very confident in the outcome.”

According to the PTO’s statistics, 73% of the completed inter partes reexaminations resulted in all claims being cancelled or disclaimed, 20% resulted in claim amendments, and only 7% resulted in all claims being confirmed. The average time for resolution is 33 months.

Based on the PTO’s actions, the judge in the patent infringement lawsuit denied Ceiva Logic’s motion for a preliminary injunction against Frame Media. The judge found that there is “a substantial question concerning the validity” of the asserted patent claims, and that Ceiva Logic “has not demonstrated a likelihood of success on the merits” in the lawsuit.

The judge also stayed the lawsuit pending the inter partes reexamination. The judge found that Ceiva Logic has not shown a likelihood of success on its patent infringement assertions, that discovery in the lawsuit is not advanced, that a delay will not prejudice Ceiva Logic, and that the reexamination will likely simplify issues. As a result of the stay, the lawsuit will not advance until the PTO finishes its reexamination.
